I hope you realize by now, and if not you should, that CBS in its entirety exists purely for the purpose of spewing Democrat propaganda. That statement encompasses both the CBS (so called) news organization and, as well in equal measure, their (so called) entertainment programming. In fact everything CBS broadcasts exudes their wildly left wing view of how they want America to be, and seeks to cancel and eradicate the existing American culture and values they detest so vehemently.

This isn’t the first time I’ve heard this one lately, so I think it deserves a bit of debate.

Please, can you produce a list of mass shooters that used the “gun-show loophole” to purchase the firearm used in their eventual shooting spree?

Also, what exactly do you mean by “nutters that should be failing background checks”? We know that background checks were performed on the mass shooters you referenced. What exactly should have been found during those background checks that would have stopped their firearm purchases?

I ask these specific questions because I have heard this argument made by people that want to restrict gun rights in order to stop mass shootings, but I have yet to have one of them answer how these proposals would have stopped the mass shootings they are concerned about.

Apologies from the mainstream media? Do not be silly. But the truth remains the truth. And the officer was never even struck!!

No, I don’t track and tabulate the seemingly daily attacks.

The gunshow loophole is more about the loonies with no evidence who claim “You’ll just stop law-abiding citizens from buying guns, not the criminals!” → “Criminals” don’t need to go through background check if they buy weapons second hand from anyone. This is the gunshow loophole. The loophole would still apply with any reasonable strengthening of regulations, it simply makes no sense to leave open such a large loophole as it undermines any other protections. It seems only logical not to leave open the gaping loophole.

The red flag law is the exact law that the gun control supporters want nationwide. Yet here it is, not accomplishing its intended goal. I don’t know how you think your argument for more red flag laws is supported by this article.

They aren’t daily. They aren’t monthly. They aren’t even annually.

The people that sell weapons to criminals are not the type of people that are going to go to an FFL to complete the sale. We barely prosecute straw purchases as it is (which I think the ATF should focus more enforcement effort on), so what makes you think a law requiring all purchases go through an FFL would be well enforced?

Regardless, I don’t have a problem with universal background checks for SALES of firearms. Most 2nd amendment supporters don’t. I have 2 other problems - (1) it won’t stop shootings [most shooters aren’t prohibited and the few prohibited shooters bought from criminals that wouldn’t have followed the law] and (2) several democrat proposed laws require checks for any type possession change, not just sales.

There’s no broadly accepted definition, so of course it depends how you define.

If you use four or more people shot in one location as the criteria, we’re way over 1 per day in 2021 (seems maybe on track for a lower rate than last year, though, which was over 600 for the y.
If you narrow it to four or more deaths and not just wounded, then you can cut that number down (I didn’t tabulate with those criteria… I’m making an estimate from looking at the table), and it is more like 1 per week.

No, the regulations aren’t weak. The amount of ATF and US Atty manpower spent on enforcement is weak. The amount of time that people convicted of gun crimes spend in jail is weak.

I was referencing how rare mass shootings done by someone using the “gun show loophole” are. It’s a loophole that isn’t actually exploited.

That’s not true. Criminal gun sellers don’t “transfer” guns to other criminals, they sell them. Law abiding gun owners “transfer” guns to each other all the time. I have 2 of my firearms in my friend’s safe right now.

Guns don’t poof into existence out of thin air. They’re manufactured. Then tracked to first point of sale.

Then they’re transferred. Any criminal gun sellers have to obtain the inventory somewhere (though I don’t have the data – maybe you do – on what proportion of firearm deaths are actually by criminals. AFAIK, usually it’s just “legally obtained” (through the weak regulations) weapons being used, and “criminals”/illegally obtained guns makes up a small minority). Right now they could just buy them secondhand and there’s no record of the transactions, or they could also steal them – but then there is at least a police report. Do you not count these criminal brokers buying the secondhand guns under the gunshow loophole as part of the gunshow loophole problem?

IMO, if you don’t track the transfers then it’s impossible to block any future illegal sales. There’s no chain of custody.

I think we might be talking past each other, so lets clarify.

  1. If we’re talking about mass shootings, the stats are clear. Those shooters are not skirting laws that are enforceable. They are either legally buying them with a background check or breaking an already existing law in obtaining them. They aren’t using the “gun show loophole.” Until you show me some stats that they are, any talk about the “gun show loophole” in the context of mass shooters is based on a false premise by you.

  2. If we are talking about violent gun crime (not suicides), then there is a case for universal background checks on all gun sales (which 2nd amendment supporters do not oppose). There is NOT a case for universal background checks on all gun transfers. There are literally tens of thousands, maybe hundreds of thousands of gun transfers between legal possessors every year that would get caught up in that law that would provide no protection against gun violence.

Perpetrators of gun violence that can’t pass a background check are not “transferring” firearms. They are obtaining them, generally, in 3 ways. They are getting them through straw purchases (already illegal and poorly enforced). They are stealing them (already illegal and poorly punished). And they are buying them on the street from people that don’t care if the law requires a universal background check. We know this because, oftentimes, even in places that don’t require background checks on person-to-person sales, those “back alley” sellers are already violating the law when selling because there are other non-background-check requirements for the sale they aren’t following (like only selling to a fellow state resident). So adding a background check requirement doesn’t mean anything to someone not even willing to ask a buyer to see an ID to make sure they live in the state where the sale is taking place. And a background check law that includes transfers also does nothing because, it is clearly unenforceable, and gun violence perpetrators aren’t getting their guns through transfers anyway.

And I would add that if we can’t keep 100,000s of illegal aliens and 500,000 tons of cocaine from getting smuggled into the US each year, I’m sure even if you pass laws to track every single legally produced gun from factory to sale to resale with the strictest possible background and mental health checks, the drug cartels would just start up gun manufacturing in Mexico or something and ship them into the US the same way they do with drugs and sell on the black market and all of this would be for nothing. And, as I said, criminals willing to kill are not going to be deterred by whatever penalties you impose for buying or selling black market guns.

I mean, maybe you built a wall or something…

Right… which is why the “seller” in any of these cases should be 100% jointly liable for any crminal and civil damages arising from their property that they haven’t properly transferred (if it were required to treat these sales as they should be).
