Alaska election officials initially disqualified Dan J. Sullivan after concluding his candidacy was not filed in good faith and was intended to confuse voters.
Superior Court Judge Thomas Matthews reversed that decision, ruling election officials lacked authority to impose an additional “good-faith” qualification and finding the state’s claim that Dan J. Sullivan intended to confuse voters was not supported by a preponderance of the evidence.
The Alaska Supreme Court upheld the ruling, putting Dan J. Sullivan back on Tuesday’s ballot.
Under Alaska’s election system, the top four finishers in the nonpartisan primary advance to November’s ranked-choice general election.
With 16 Senate candidates on Tuesday’s ballot, both men named Sullivan could potentially advance.
