The fight began late last week, after a three-judge panel on the federal 3rd Circuit Court of Appeals issued a judgment that undated ballots in a 2021 county judgeship election should be counted.
McCormick’s lawsuit, filed in state court, sues the state’s chief election official and county election board in order to compel them to count the undated ballots that were returned on time.
The 3rd Circuit Court of Appeals ruled on Friday that the state’s laws requiring ballots be dated by the voter was “immaterial” under a federal statute that originated with the Civil Rights Act of 1964 — meaning it should have no bearing over whether ballots are accepted or rejected.
But the court did not release its full formal opinion, so there has been uncertainty on how — or whether — to apply its finding to other elections aside from that 2021 judgeship contest.
The circuit court may not be the final say on the order. One of the parties in the case — David Ritter, a candidate in that judicial race — asked the court on Monday to stay its judgment, signaling that there would likely be an appeal to the U.S. Supreme Court.
The Pennsylvania Department of State’s guidance to counties on these ballots, issued Tuesday morning, nods toward that legal uncertainty.
“Now, in light of the conclusion of the Third Circuit in Migliori it is the Department’s position that ballots with an undated return envelope must also be counted for the May 17, 2022, Primary,” the guidance read. “However, out of an abundance of caution the Department advises, that those ballots should be segregated and remain segregated from all other voted ballots during the process of canvassing and tabulation.”
Wow! This has got to be a gut wrenching quandary for the tree huggers, global warming hysterics, and liberals/progressives/socialists/commies in general.

Holy Cow! (and not the East Indian ones). I don’t mind the idea of open primaries, but don’t reward dolts for not planning ahead. They might see a certified, verified, fact-checked, guaranteed tweet on the way to the polling booth suggesting they switch party affiliation for the day and vote for the weakest candidate. A couple of days later, the it becomes a decertified tweet, and we’ve got Chinese collusion.

True. He acquitted himself very well. But he is far behind in the polls because he and Trump disagree on discussing the 2020 outcome. Also McConnell is supporting Katie with a WHOLE lot of money!!
Right now I’m not at all certain Brooks will win the runoff, even though he clearly is the better candidate.
Brooks opponent is a lightweight who has never held elective office. Her sole distinction is being chief of staff for the corrupt, porker Alabama senator Shelby in 2016-2018. It is telling that she refused to come on FNS. She’s not ready for prime time and she knows it.
Performances like the one today on FNS will go a long way for Brooks to overcome the turtle’s negative ads.
As we have discussed, Trump has long since worn out his welcome with me. The Brooks de-endorsement was particularly petty.
The Alabama runoff will be on June 21. Will be interesting.
I continue to support many of Trump’s policy positions. But pettiness is a Trump specialty. He cannot let go of 2020. The American people want to look forward, not back. The focus needs to be on Biden’s manifold failures, not Trump’s oversized vanity.
It appears now, with the mules thing, more than ever that there was serious cheating in 2020. But that does not mean Trump won. Even without the cheating Biden might have squeaked out a victory. But the election would have been much closer, that is for certain, absent the cheating.
It’s a shame in America today, when elections are very close, that it becomes so difficult precisely to identify the winner. Look at the current PA Senate Republican primary as another example. Well over a million votes were cast and fewer than one thousand votes separate the candidates. Who won? Who knows for sure?
In a Friday ruling, the First District Court of Appeals strongly condemned the decision of a federal judge in Florida to issue a preliminary injunction against the state’s newly-drawn congressional map.
That’s because, with some exceptions, it use to be that everyone voted by going to the polling place where they were registered, and casting their vote. Then it was just a matter of counting/tabulating those votes. Today, there’s so much early voting and voting by mail and other rules and exceptions, that an accurate vote count is no longer all that’s necessary to ensure a fair and reliable election. The actual election results have become about as reliable as random polling data, since many of the rules and restrictions and procedures to ensure voting accuracy have suddenly been made ‘optional’.
Edit. Despite sky high gasoline prices and other inflation, rampant crime especially in Frisco and LA, no plans to provide water during a severe drought, and many more problems, Newsom is probably still a lock. I only hope that he gets a republican as an opponent in the general election after California’s jungle primary.

The first 50% of California’s water flows out to the Pacific Ocean for fish and environmental purposes – something the Public Policy Institute of California verified in 2019: “Water in California is shared across three main sectors. Statewide, average water use is roughly 50% environmental, 40% agricultural, and 10% urban.”
Keep those numbers in mind. Instead of taking on the enviros, Newsom is trying to force people not to flush the toilet.
Like you, I used to be skeptical of ranked-choice voting. What tipped me over to liking it is what happened here last year. A ranked-choice open convention primary got Glenn Youngkin the nomination in Virginia and helped turn our blue state back to reddish purple, at least for a few years. There were a few republican primary candidates that were more Trumpy and controversial that likely would fared better in an open winner-takes-all primary. Considering how unliked Trump is among suburban educated white women, and how well Youngkin did with that demographic, it is likely that without ranked-choice-voting, we would have Bill Clinton Jr. (Terry McAuliffe) as our current governor. I support Alaska’s decision to use ranked-choice voting in their republican primary.
But “Operation Chaos” is alive and well in the 2022 elections!!

and it’s power is being directed by Democrats and liberal Republicans against Conservatives. The equivalent of “Operation Chaos” has already shown its teeth powerfully in Georgia. There are concerns about Alaska, Michigan, Wyoming, and elsewhere.
This sort of story harkens me back to the 2014 Mississippi Republican Senate primary. We had a wonderful, young, Conservative candidate at that time, Chris McDaniel, who was opposed by “Old Thad” Thad Cochran.
McDaniel was the easy choice among Mississippi’s Republican voters. But McConnell, who controlled a lot of money, did not want a Conservative in that Senate slot. So what did that SOB McConnell do?
He used his money to fire up Mississippi Democrats to vote for “Old Thad” in the Republican primary. Hence Cochran won, and McConnell had his stooge. But a great many Conservatives, like myself, were pissed off as hell.
Add Alabama to your list. I donated to Mo Brooks campaign (mobrooks.com ) this weekend. Even though we don’t have anywhere near the deep pockets of McConnel’s Washington swamp donors, there are a lot more of us than there are of them. Also, the race does not go to the one with the most money. A candidate just has to have enough money to get his case before the voters.
